Why online voting?
Very few homeowners have the time and ability to go to HOA meetings. Indiana HOA law says you have a right to vote even if you're unable to physically attend.
Until now, the only way to do this was via mail, which leads to ballots not being counted if not filled out perfectly.
To quote an announcement following a recent neighborhood vote:
"There were also ballots submitted without a selection of yes/no and ballots submitted the homeowners were ineligible to vote."
These ballots were thrown out. Maybe for a reason as simple as, "the wrong homeowner filled out the ballot."
We created Tamarack EasyVote to make sure that never happens again.
How does it work?

Is this allowed? (simple answer)
Yes. Indiana law allows this, and Tamarack’s bylaws require compliance with Indiana law.
Owners are allowed to independently create and use valid proxy forms. A valid proxy cannot be rejected by the HOA solely because it was created by an Owner/member, signed electronically, or submitted electronically.
Written ballots and other voting documents also cannot be rejected solely because they are signed or transmitted electronically.

Is this allowed? (full answer)
Yes. Indiana law recognizes electronic signatures and electronic records, and the Indiana HOA Act expressly allows HOA proxies to be signed and submitted electronically. Tamarack EasyVote is designed so that an Owner may electronically sign, authorize, and transmit HOA voting documents, including proxy designations and written ballots where applicable.
We have built this process to comply with the Tamarack Bylaws, the Tamarack Covenants, and Indiana state law.
Tamarack Bylaws Article II, Section 2.05(d) states:
“An Owner may vote either in person, by mail and/or written ballot or by his duly authorized and designated attorney-in-fact.”
This means an Owner does not have to be physically present at a meeting in order to participate. An Owner may vote by written ballot, and an Owner may also authorize another person to vote on the Owner’s behalf through a valid proxy designation.
Tamarack Bylaws Article III, Section 3.16 requires the Association to comply with the Indiana Homeowners Association Act:
“[T]he Corporation shall be run with due regard and in compliance with the Homeowner’s Association Act, Indiana Code Section 32-25.5 et seq., as amended (the ‘HOA Act’).”
That same bylaw further provides:
“In the event of a conflict between the Declaration, HOA Act and these By-Laws, the HOA Act shall control.”
Some voting documents may be proxies, and some may be written ballots or other HOA voting forms. The legal basis is slightly different, but the result is the same: an electronic signature cannot be rejected merely because it is electronic.
For proxies, Indiana law is explicit.
Indiana Code Section 32-25.5-3-10(b)(5) requires an HOA proxy to include the member’s signature, “whether executed by hand or as an electronic signature.”
Indiana Code Section 32-25.5-3-10(g)(4) further provides that a member may submit a compliant proxy by “electronic mail or other electronic means.”
Indiana law also expressly allows members to use their own proxy form. Indiana Code Section 32-25.5-3-10(e) states:
“A member may create and use a proxy form designed by the member if the form complies with the requirements of subsection (b).”
This means the HOA cannot require Owners to use only a board-created proxy form, so long as the Owner-created proxy includes the information required by Indiana Code Section 32-25.5-3-10(b).
For written ballots and other voting documents, Indiana’s Uniform Electronic Transactions Act recognizes electronic records and electronic signatures, and Tamarack’s own bylaws allow Owners to vote “by mail and/or written ballot” or through a duly authorized attorney-in-fact.
Therefore, if a proxy satisfies the statutory requirements of Indiana Code Section 32-25.5-3-10, the Association cannot reject it merely because it was signed electronically or submitted electronically.
Tamarack has also accepted electronic submissions in the past. For example, the Association has previously directed Owners to submit proxy/ballot materials by email to Associa, including the October 28, 2025 communication regarding Shed Amendment ballots. That prior practice is consistent with Indiana law and confirms that electronic submission is not a new or improper process.
Beginning July 1, 2026, Indiana’s newly passed HB 1115 / Public Law 155 further confirms that HOA members must be considered in attendance at an HOA meeting when attending “by remote or virtual means” in accordance with Indiana’s nonprofit corporation remote-meeting procedures.
The process used by Tamarack EasyVote includes an additional safeguard: identity verification. The system is designed to confirm that each submission comes from an eligible Owner and to help ensure that each valid proxy and vote is properly counted.
Bottom line: electronic proxy signatures and electronic proxy submissions are allowed under Indiana law, required to be accepted when valid, and consistent with Tamarack’s governing documents and prior HOA practice.

Is my information safe?

You will enter your name & birthday, take a picture of your ID, then take a selfie. The system will automatically verify that you are who you say you are.
Nobody will see your personal information.
The only thing anyone (including Associa) will see is proof that you are the person who signed the document.
We recommend including your phone number so we (or Associa) can call you if additional identity verification is required.
Does this work like a paper signature?
It works better than a paper signature.
When you sign something on paper, you can't prove it was you unless someone saw you sign it in person. These votes are easily thrown out.
When you send your ballot through the mail, you can't guarantee it will get there in time.
Once Associa receives your paper ballot, you can't guarantee they will open it in time.
Once Associa opens your ballot, you can't guarantee they won't find something wrong with your ballot.
There are too many reasons that not all votes are counted, and it's important to make sure every homeowner has equal voting access.
